Surrogacy Laws by State and Province Explained

Surrogacy laws are like a map — beautiful but complex. Knowing where and how to start matters. Here’s how the U.S. and Canada differ, and why partnering with Surrogacy4All makes navigation simple.

United States – The Patchwork of State Laws

Category Example States Status
Fully Legal (Compensated Surrogacy) CA, NY, CT, IL, NV Allowed with strong protections
Altruistic Only / Restricted LA, MI, NE Partial legality
Case-by-Case FL, TX, CO, OR Requires judicial approval

Each contract is customized per state law. We partner with licensed attorneys in all 50 states to ensure every arrangement stands firm in court.

Canada – Nationwide Altruistic Framework

Under the Assisted Human Reproduction Act (AHR Act), Canada allows surrogacy only for altruistic reasons.
This means:

  • Surrogates can’t be paid beyond expenses.
  • Advertising for paid surrogacy is illegal.
  • All reimbursements must be documented.

Surrogacy4All assists with documentation to keep every transaction legally compliant.

Cross-Border Protection

If your surrogate lives in Canada and you’re an American intended parent, dual legal agreements are required:

  • Canadian GCA
  • U.S. parentage filing

Our bilingual legal team handles both jurisdictions seamlessly.

Parent Quote

“We were terrified about the legal maze between Ontario and New York, but Surrogacy4All made it effortless. They handled everything — even citizenship papers.”
