Statistics: IVF and Egg Donation in the US

Each year, over 330,000 IVF cycles are initiated in the United States, according to the Society for Assisted Reproductive Technology (SART). Of these, roughly 12%—around 40,000 cycles—involve the use of donor eggs. Many families turn to egg donation after unsuccessful IVF attempts with their own eggs or when genetic compatibility is not possible, making donor agencies an essential part of their paths to parenthood.

What Intended Parents Want

It is estimated there are about 300 agencies in the USA, many offering both egg donation and surrogacy. When searching for an egg donor agency, most intended parents prioritize:

  • Physical resemblance: Hoping for a donor whose traits align with the family—whether mirroring a partner’s, parents, or cherished features.
  • Health and flexibility: Agencies usually thoroughly screen donors for physical and mental wellbeing, and donors should be open to the unique needs of intended parents.
  • Cost and availability: Clear, fair pricing and accessible donor profiles matter. Families want options for either fresh or frozen donor eggs that fit their timelines, budgets, and dreams.
  • Guaranteed egg quality :  Parents want a baby not just donor eggs or embryos. Egg Banks typically offer guarantees on frozen eggs becoming 2 or 3 embryos but that does not mean the embryos will become blastocysts.
  • Guaranteed day 5 blastocysts: Good quality day 5 blastocysts offer the best chance of pregnancy. Which is why doctors prefer embryos at this stage of development to be available for transfer. Many embryos do  not become blastocysts, and Intended Parents lose their monies.  Hence  smart consumers are moving to agencies that offer guaranteed Blastocysts.   

The following Table 1 compares average  total cost including donor compensation, medication and IVF expenses to create three blastocysts to have one to two babies. Fresh cycles average about 12 eggs per donation and this is used to compare cost options.

  • One stop single shop model: Most Intended Parents specially  LGBTQ prefer  a one stop single shop model so they can get their egg donor and surrogate from the same agency, without the  risk and disconnect of having to coordinate two agencies plus an IVF Center to have their baby.

The Industry Today:

  • The industry has changed:
    • About 30 years ago the only real option was to get a donor for a fresh cycle, giving rise to about 200+ egg donor agencies that offered fresh cycle donors.
      • However these are costly and the results varied by egg donor and embryology lab at the IVF Clinic.   Waiting time for a donor is extensive.
    • About 15 years ago thanks to improvements in vitrification technology, the industry gave rise to about 20 frozen donor egg banks.
      • A lower cost and improved option over using a fresh  donor. These offered immediate donor eggs of M2 quality.
      • However frozen eggs are very delicate and are affected by shipping and defrosting protocols.  Even  minor changes in temperature and techniques can cause failure of the embryo creation cycle.
      • As a result, the number of embryos created varies by the transportation protocol and the embryology lab used.
    • About 3 years ago  the industry started to shift to  guaranteed Day 5 Blastocysts and surrogacy (if needed).  This helps the Intended Parent achieve the highest success rates from surrogacy at the lowest cost
  • The 10 agencies that offer these day 5 guaranteed blastocyst are hence ranked as Tier 1 options in  Table 3  below

But beyond these practicalities lies a deeper need: warmth, guidance, and genuine support from the agency team.

Keeping Families Safe: Recognizing Risks and Scams

Sadly, not every agency operates with integrity. As highlighted by recent articles in the Wall Street Journal, the rise of online frauds and fake websites means families must stay vigilant. Watch out for:

  • Lack of licensing or credentials
  • Promises that sound “too good to be true”
  • Poor communication or evasive answers
  • No clear physical address or staff

Fortunately, there are   Government regulatory oversight organizations to help families find honest, capable agencies  These include:

FDA (Federal Drug Administration ):

FDA’s Role in Egg/Embryo Movement
All agencies handling frozen human reproductive tissue must register as Human Cell and Tissue Establishments. Failure to register can result in FDA warning letters, injunctions, seizure of materials, and criminal penalties. Civil fines can reach up to $500,000, and individuals may face imprisonment for willful violations.

  • Transporting gametes across state lines is specifically covered because the FDA’s authority stems from the Interstate Commerce Clause. If frozen eggs cross state boundaries, FDA jurisdiction is absolute.
  • Unregistered agencies cannot legally ship or distribute eggs between states.
  • Even if the medical procedure occurs within a licensed clinic, the sourcing and receiving agency must itself be FDA-registered. Otherwise:
    • The shipment is considered adulterated and misbranded under the Federal Food, Drug, and Cosmetic Act. Clinics receiving tissue from an unregistered source are also at risk of enforcement.

Note: FDA Exception for Agencies that only do Fresh Donor Cycles

Agencies that only arrange fresh donor cycles and refer donors directly to licensed IVF clinics typically do not need their own tissue bank license, since they are not collecting, storing, or transporting frozen eggs.

  • Referring donors across states for fresh cycles is legal as long as the agency does not itself handle the eggs. In these cases, the regulatory responsibility rests with the IVF clinic performing the medical procedures, which must be FDA-registered and state-licensed where required.  The following table refers to State licensing requirements for agencies.

New York State (NYS):

New York has become the De Facto national standard for Agencies to be registered as it is the only state that licenses both Egg Donor and Surrogacy agencies.   Many egg banks and agencies in other states provide eggs to NYS residents and cannot do so without registration.  Hence we have used their standards in our guide.
– Agencies must be licensed as tissue banks under NY Public Health Law Article 43-B.
– Operating without a license can lead to civil fines up to $10,000 per violation and potential criminal charges.
