Why licensing matters in Surrogacy

New York is the only US state that licenses surrogacy programs. Under the Child-Parent Security Act, a licensed program must meet financial, operational and ethical standards set by the New York State Department of Health, carry the required insurance and escrow protections, and honour the Surrogates’ Bill of Rights. Most agencies in the United States are unlicensed because their states do not license them; that is legal, but it means no regulator is checking. Surrogacy4All has operated under New York licensing since the program began in 2006.

Tissue bank licenses and registrations

Because we screen and coordinate donors and gestational carriers under our own medical direction, we hold tissue bank licenses where the law requires them for the handling of reproductive cells and tissue.

Registration with the FDA and Health Canada means the establishment is listed and subject to inspection under the applicable regulations for human cells and tissues. It is not a certification, approval or endorsement, and we do not describe it as one.

Medical Direction

The program’s clinical protocols are directed by Rashmi Gulati, MD, Board Certified in Internal Medicine, Medical Director since 2004, with privileges at Mount Sinai Hospital. Surrogate and donor screening is performed under physician direction at our New York clinic and coordinated with our clinics in Toronto and Accra.

Insurance and Escrow

Client funds are held by an independent escrow company under a written escrow agreement, released against milestones; Surrogacy4All does not hold client funds. The agency carries the professional and general liability coverage required by New York licensing. Details of escrow and milestone payments are on the fees page.
