Due to the current laws in India we have temporarily suspended surrogacy there.
Surrogacy in India used to be available for all, offering a unique alternative for both married couples as well as single men & women, who were seeking low-cost accessible surrogacy.
It is estimated that it was a $400 million per year marketplace. We proudly sent many Intended Parents to India until 2015. In 2015, the Government of India restricted pregnancy to Indian Nationals only.

Surrogacy Laws in India:
Couples, whether, married or not, who want to have a surrogate baby need to meet a stringent set of criteria, including how long they have been married and proving other infertility treatment has not worked.
The new laws make surrogacy available only to married couples.
Cost: We offer Surrogacy for Indian couples in India for $39,000. This includes all costs associated with the surrogate carrying embryos through delivery of your baby.
Surrogacy for Single Men and Women and LGBT couples is banned completely
So, if you are a Single Male or Female and wish to have a baby, you need to do it outside India. We offer surrogacy options to carry embryos through baby delivery in Ghana for $49,000, and in the USA for $119,000. Babies born in Ghana will be Indian citizens, while babies born in the USA will be American citizens.
Surrogacy Options for Indians Residing outside India
If you reside outside India, keep in mind the baby born in India will be an Indian Citizen, and you will have to apply for a visa at the US Embassy to bring the baby out of India.
The process is as follows:
- Contact our office and will send you the paperwork to complete. The contracts specify in detail the services and payment options in installments.
- We offer surrogacy options in two locations – New Delhi and Mumbai.
- Please specify which location you prefer in the paperwork.

You will then have to make two trips to India.
- The initial trip is to give a sperm specimen by the Intended Father. This sample is frozen at the IVF Center.
- IVF is then done to harvest eggs from the intended mother, unless you use an egg donor. Beautiful and brilliant premium egg donors are readily available
- Discuss with the center in India any specific needs you have for the surrogate including carrying twins.
- We then work with the IVF Center, help select the surrogate based on your specifications, provide you with an egg donor as needed, and manage the entire process for you from start through finish.
- You then go to India about 12 months later to witness the birth of your baby and bring the baby back home with you.
- Our attorneys in India, will help coordinate getting the birth certificates, getting an Indian passport for your baby, and arranging an appointment at the US Consulate to get a visa to bring your baby back to your home.
The option of shipping frozen eggs to India, shipping sperm or shipping frozen embryos to India is no longer legal. This has been enforced strictly to avoid couples from violating the “No sex selection of baby” laws in India.

You do not have to travel outside India to give a sperm sample, unless you want to. Instead, you can collect the sperm and freeze it at our affiliated IVF Clinic in Mumbai, and we will arrange for a carrier to hand carry it for you by air to our Surrogacy center outside India.

Choices we can offer you:
Sex Selection:
Many Intended Parents have preference whether they want a Son or Daughter. To give you this option, the IVF Centers we work with do PGS on your embryos after they are created. Then the embryo of your sex choice is inserted in the surrogate mother to carry for nine months
Citizenship:
USA Surrogacy: A baby born in the USA, will automatically be a USA Citizen by birth, even if you are an Indian national
India, Ghana, and Ukraine Surrogacy: A baby born in these countries, will have your citizenship. For example, if you are an Indian national, the baby born will be an Indian national.
Selection of surrogate:
Many Intended parents ask if the baby will be black if carried by a black surrogate. The answer is that the ethnic background of the surrogate has no effect upon the ethnicity of the baby.
Similarly of carried in Ukraine by a Caucasian surrogate, the baby will not be white but will look like you who are the Intended Parents
Surrogacy in the USA is not anonymous. You and the surrogate know each other’s identity ad can communicate during and after the surrogate process
After pregnancy, the surrogate lives at home, but sings an agreement to not drink smoke, or take drugs during the pregnancy. Success rates are around 50%.
Surrogacy in Ukraine and Ghana is anonymous: You do not know the surrogate’s identity. She does not know who you are. The medical clinic does the selection. The benefit is that since the clinic does the selection, if the first try fails the second try is provided at an exceptionally low charge, assuming embryos are available to implant.
After pregnancy in Ghana and for a limited period on occasion in Ukraine, the surrogate lives in a dormitory near the clinic with other surrogates. Her food, nutrition and medical needs are provided, to help ensure a successful pregnancy. During this time, she cannot drink, smoke, take drugs or have sex, to maximize the success rate of the pregnancy. It is running about 70%.
The Pregnancy:
During the first six weeks the surrogate is monitored by the IVF doctor. At the end of six weeks, the IVF Physician does a handoff to her Gynecologist, who then monitors the surrogate through the pregnancy. At the end of the pregnancy, the surrogate then is referred to an Obstetrician for delivery of the baby.
During the pregnancy process, we will send you monthly reports of how the surrogate is doing. If you have any questions or concerns, we are here to help you address them as needed.
Legal issues:
In the USA, California is the State with the laws most in favor of the Intended Parent. Hence, we recommend your surrogate be born under California law. To make this work, the embryo preferably must be implanted in the surrogate in California and baby delivery preferably should be in California. We work closely with IVF Clinics in the Los Angeles area, that we would recommend to you to use.
We will also refer you to excellent legal counsel to manage all he paperwork.
In Ghana, the IVF Center is a major women’s hospital and provides the IVF, Gynecologist and Obstetrician services as part of your surrogacy package.
Birth of the Baby:
So now the best part and your baby is about to be born!
It is recommended you arrive the Hospital a couple of days before the baby is delivered, so you can witness the baby being bor. A soon as the baby is born, the Nurse wraps it in towels and gives it to you to hold. You are now the proud parents of this newborn bundle of joy!
The baby is then taken to a different floor in the hospital to the NICU, Newborn Intensive Care Unit, for cleanup and a physician examination, to ensure the baby is fine.
This takes a couple of days, after which you can take the baby home!
Bringing the baby Home:
In the USA before and after the baby is born certain legal papers must be filed and a USA Social Security number, and USA Passport must be issued for the baby. Allow 2 to 4 weeks for this to happen.
In Ghana and Ukraine, after the baby is born, a DNA Test is done using a Saliva sample, to confirm the baby is yours. If you are an Indian citizen, the Indian embassy in Ghana will then issue the baby an Indian passport to bring the baby to India

Please note: Costs assume that you have embryos available to transfer for the surrogate to carry. Costs are all inclusive and cover all medical and delivery procedures, as well as the surrogate’s and the baby’s hospitalization, but exclude some medical complications. No additional expenses are expected, except parent’s travel expenses and local legal procedures at the parents’ country of origin.
What kind of facilities are available in India for Surrogacy?
Many of us have a mental image of India being mud huts and Elephants. Yes, they are there, but the IVF Centers you will use are far removed from this image.
